The NCHEA recommends parents investigating homeschooling review the documents/forms filed with the Nebraska Department of Education (NDE) that serve as notification of the parents' decision to home educate. Note: parents notify the NDE of their decision to homeschool their children; parents are not seeking permission or authority to home educate.

Rule 13 and 12 Forms
The links on this page will take the user to the Nebraska Department of Education (NDE) web site, where the forms used to provide notice to the NDE of the parent(s)' decision to home educate their child(ren) can be downloaded. On the NDE web site, the user can select the appropriate forms, Rule 12 or Rule 13, as well as copies of the actual Rules implementing the statutes applicable to homeschooling.
Nebraska law recognizes homeschooling for two reasons, when attendance at an approved and accredited school would:
1) Violate sincerely held religious beliefs of parents or legal guardians (Rule 13) or
2) Interfere with the decisions of the parents or legal guardians in directing their child's education (Rule 12).

Affidavit to Delay Entry into an Exempt School
State law requires compulsory school attendance if the student is 6 years of age before January 1 of the school year for which Rule 13 or Rule 12 forms are filed. This compulsory attendance situation also applies to homeschooled students. Parents can delay the start of homeschooling until age seven (7) by filing an affidavit with the local school district; the NCHEA has developed a Parent or Guardian Affidavit to Delay Entry into an Exempt School for this situation.
